Terms of Service

1. Acceptance of Terms
By accessing or using the Survd web application (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users, including customers, vendors, staff members, and guests.
2. About Survd
Survd is a marketplace platform that connects customers with service vendors (barbers, hairstylists, nail technicians, massage therapists, makeup artists, tattoo artists, and other personal service providers). We facilitate bookings, payments, and communications between customers and vendors. Survd is not itself a service provider and does not employ or control the vendors on the Platform.
3. Eligibility
You must be at least 16 years of age to use Survd. By creating an account, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian. We reserve the right to request proof of age at any time and to suspend accounts that do not meet this requirement.
4. User Accounts
4.1 Registration
You may register using your email address, Google account, Apple account, or phone number. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4.2 Accuracy
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. Providing false or misleading information may result in suspension or termination of your account.
4.3 Account Security
You must notify us immediately if you suspect any unauthorised use of your account. Survd is not liable for any loss arising from unauthorised access to your account.
5. Customer Terms
5.1 Bookings
When you book a service through Survd, you enter into an agreement with the vendor, not with Survd. We act as an intermediary to facilitate the booking. Some vendors require booking confirmation before the appointment is finalised. Once confirmed, the booking is binding subject to the cancellation policy.
5.2 Guest Bookings
Certain vendors allow guest bookings without a registered account. Guest users must provide a valid name, email, and phone number. A device identifier will be stored in your browser to associate your bookings and reviews.
5.3 Payments
Payments are processed securely through Stripe. You may pay by card (credit or debit). Cash payments may also be accepted where the vendor has enabled this option. A service fee of 2.5% applies to card transactions.
5.4 Cancellations
Cancellation policies are set by individual vendors and are displayed at the time of booking. If you cancel a booking, a cancellation fee may be charged in accordance with the vendor's policy. Please review the vendor's cancellation terms before confirming your booking.
5.5 Refunds
Refund requests can be submitted through the Platform for eligible bookings. Refunds are reviewed and processed by the vendor. Approved refunds are returned to the original payment method via Stripe. Survd may intervene in refund disputes at its discretion but is not obligated to do so.
5.6 Late Arrivals & No-Shows
Vendors may charge fees for late arrivals or no-shows as specified in their business policies. These fees will be charged to your payment method on file. It is your responsibility to arrive on time for your appointment.
6. Vendor Terms
6.1 Onboarding
To offer services on Survd, you must complete the vendor onboarding process, providing your business information, service categories, and accepting these Terms. You represent that all information you provide is accurate and that you hold any licences or certifications required to perform your services.
6.2 Service Listings
You are responsible for keeping your service listings, pricing, availability, and business policies accurate and up to date. To appear in customer search results, you must upload a profile image and at least one business or portfolio image.
6.3 Earnings & Payouts
Vendor payouts are processed through Stripe Connect. You must complete Stripe's identity verification and provide valid banking details to receive payouts. Survd is not responsible for delays caused by Stripe's verification process. Earnings from completed appointments will be made available for payout according to the payout schedule.
6.4 Staff Management
Vendors may invite staff members to their team. You are responsible for the actions of your staff on the Platform. Staff permissions (appointments, services, earnings, clients) are configurable and under your control.
6.5 Customer Blocking
Vendors may block customers from booking their services. Blocked customers will be unable to make bookings or send messages to the vendor.
7. Messaging
The Platform provides an in-app messaging system for communication between customers and vendors regarding bookings and services. You agree not to use messaging for spam, harassment, solicitation of services outside the Platform, or any unlawful purpose. We reserve the right to monitor messages for safety and compliance purposes.
8. Reviews & Ratings
Customers may leave reviews and ratings for vendors after completed appointments. Reviews must be honest, relevant, and based on genuine experiences. Abusive, defamatory, or fraudulent reviews may be removed at our discretion. Vendors may not incentivise or coerce customers into leaving or removing reviews.
9. Location Services
Certain features of the Platform require access to your device's location, including finding nearby vendors and calculating distances. Location access is permission-based and can be denied or revoked at any time through your browser settings. If you deny location access, some features may be limited.
10. Prohibited Conduct
You agree not to:
- Provide false or misleading information
- Use the Platform for any unlawful purpose
- Harass, abuse, or threaten other users
- Impersonate another person or entity
- Attempt to gain unauthorised access to other accounts or our systems
- Interfere with or disrupt the Platform's functionality
- Circumvent fees by arranging services outside the Platform after initial contact through Survd
- Post spam, offensive content, or content that violates the rights of others
- Use automated tools, bots, or scrapers to access the Platform
11. Intellectual Property
All content, branding, design, and software on the Platform are owned by Survd or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
By uploading images, reviews, or other content to the Platform, you grant Survd a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with operating and promoting the Platform.
12. Limitation of Liability
Survd acts as an intermediary between customers and vendors. We are not responsible for the quality, safety, legality, or delivery of any services provided by vendors. To the maximum extent permitted by law:
- Survd is not liable for any disputes between customers and vendors
- Survd is not liable for any loss, injury, or damage arising from services booked through the Platform
- The Platform is provided "as is" without warranties of any kind, express or implied
- Our total liability to you shall not exceed the amount you have paid to Survd in the 12 months preceding the claim
13. Indemnification
You agree to indemnify and hold harmless Survd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another user or third party.
14. Account Suspension & Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate. You may also close your account by contacting us. Upon termination, your right to use the Platform ceases immediately.
15. Dispute Resolution
If you have a dispute with another user, we encourage you to resolve it directly. Survd may, but is not obligated to, assist in resolving disputes between customers and vendors, including refund disputes. For disputes with Survd, you agree to first contact us to attempt informal resolution before pursuing any formal proceedings.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
